Terms of Service

Welcome to Gemzy. These Terms of Service (“Terms”) govern your use of the Gemzy app, website, and related services (together, the “Services”). By creating an account or using Gemzy, you agree to these Terms. Please read them carefully.

1. Company Information

Gemzy (“we,” “our,” or “us”) provides the Services.

2. Eligibility

You must be at least 18 years old to use Gemzy.

Both individuals and businesses/brands may create accounts.

Future team features will allow administrators to manage coworker access.

3. Accounts

To create an account, you may sign up using Email, Google, or Apple sign-in.

Multiple accounts are allowed, but activity may be monitored in the future to prevent misuse.

You are responsible for maintaining the security of your account credentials.

We reserve the right to suspend or terminate accounts that violate these Terms (e.g., illegal or abusive content).

4. User Content and Ownership

You may upload jewelry designs, model photos, and other creative content to Gemzy.

You retain ownership of all content you upload and of the content you generate within Gemzy.
You grant us a limited license to process and store your content as necessary to operate the Services and to generate your results.
We do not view the content of the images you upload or generate, and we do not use your images to train AI models.
We will not use your content for marketing or promotional purposes without your separate, explicit consent.
You are responsible for ensuring your content complies with applicable laws and does not infringe on third-party rights.

5. AI-Generated Content

Gemzy uses third-party AI technologies to generate imagery. You understand and agree that:

Generated outputs are not guaranteed to be unique, and similar or comparable outputs may be generated for other users.
We make no warranty that generated content is free of errors, suitable for any particular purpose, or free from unintended results.
We make no warranty that generated content does not infringe third-party rights. You are responsible for reviewing generated content before using it publicly or commercially.

6. Acceptable Use

You agree not to use the Services to:

Upload content you do not own or have the rights to use, including another party’s designs or photographs.
Create misleading endorsements, or content that impersonates real people or brands without authorization.
Upload or generate illegal, infringing, abusive, or otherwise prohibited content.
Copy, resell, or reverse-engineer the Services.

7. Payments, Subscriptions & Refunds

Payments are processed securely through the Apple App Store and Google Play, and may include Stripe or PayPal in the future.

Subscriptions auto-renew through the Apple App Store or Google Play. Renewal, billing cycles, and cancellation are managed by the relevant app store through your account settings there.
Refunds may be requested by emailing us at privacy@gemzy.co and will be granted at our discretion if they comply with these Terms.
Subscription and in-app purchase refunds may also be subject to the policies of the App Store or Google Play.

8. Intellectual Property

All Gemzy branding, design, and trademarks are the property of Gemzy.

Users are prohibited from copying, reselling, or reverse-engineering Gemzy’s Services.
While Gemzy uses third-party AI technologies to generate content, our platform design, visual identity, and user experience are protected by intellectual property rights.

9. Limitations of Liability

Gemzy is provided “as is” without warranties of any kind.

We are not liable for any damages, loss of data, downtime, or third-party issues.
We do not guarantee that generated content will be free of errors, suitable for every purpose, or free from unintended results.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms.

You may freeze or permanently delete your account at any time through your account settings or by contacting us.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules, and the competent courts of Tel Aviv-Jaffa, Israel will have exclusive jurisdiction over any dispute, except where applicable law provides otherwise.

Nothing in this section deprives you of the protection of mandatory consumer-protection rights available to you under the laws of your country of residence. If you are a consumer in a jurisdiction whose laws guarantee you rights that cannot be waived by contract, those rights continue to apply to you.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email / in-app pop-ups before they take effect.

13. Account Deletion and Deactivation

Users may delete or deactivate their account at any time directly within the app. To do so, navigate to Account Settings, scroll to the bottom of the screen, and select Delete Account.

Upon selecting Delete Account, you will be presented with the option to either permanently delete the account or temporarily deactivate it.

Account Deletion will result in the permanent removal of your account and associated personal data, subject to applicable legal and regulatory retention requirements and the 30-day retention period described in our Privacy Policy. Once deleted, the account cannot be recovered.
Account Deactivation will temporarily disable your account. The account and associated data will be retained and may be reactivated by you at a later time.

The deletion or deactivation process is completed entirely within the app and does not require contacting customer support.
