Welcome to Gemzy. These Terms of Service (“Terms”) govern your use of the Gemzy app, website, and related services (together, the “Services”). By creating an account or using Gemzy, you agree to these Terms. Please read them carefully.

2. Eligibility

You must be at least 18 years old to use Gemzy.

  • Both individuals and businesses/brands may create accounts.

  • Future team features will allow administrators to manage coworker access.

3. Accounts

To create an account, you may sign up using Email, Google, or Apple sign-in.

  • Multiple accounts are allowed, but activity may be monitored in the future to prevent misuse.

  • You are responsible for maintaining the security of your account credentials.

  • We reserve the right to suspend or terminate accounts that violate these Terms (e.g., illegal or abusive content).

4. User Content

You may upload jewelry designs, model photos, and other creative content to Gemzy.

  • You retain ownership of all content you create or generate within Gemzy.

  • By using Gemzy, you grant us a limited license to use your content only for operating, improving, and marketing the Services, with your consent.

  • You are responsible for ensuring your content complies with applicable laws and does not infringe on third-party rights.

5. Payments & Refunds

Payments are processed securely through Apple Pay, Google Pay, and may include Stripe or PayPal in the future.

  • Refunds may be requested by emailing us at privacy@gemzy.co. Refunds will be granted at our discretion if they comply with these Terms.

  • Subscription and in-app purchase refunds may also be subject to the policies of the App Store or Google Play.

6. Intellectual Property

All Gemzy branding, design, and trademarks are the property of Gemzy.

  • Users are prohibited from copying, reselling, or reverse-engineering Gemzy’s Services.

  • While Gemzy uses third-party AI technologies to generate content, our platform design, visual identity, and user experience are protected by intellectual property rights.

7. Limitations of Liability

Gemzy is provided “as is” without warranties of any kind.

  • We are not liable for any damages, loss of data, downtime, or third-party issues.

  • We do not guarantee that generated content will be free of errors, suitable for every purpose, or free from unintended results.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms.

  • You may freeze or permanently delete your account at any time through your account settings or by contacting us.

9. Governing Law & Dispute Resolution

These Terms will be governed by the laws of any applicable jurisdiction.

Any disputes will be resolved under applicable law in the relevant jurisdiction, unless otherwise required.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email and in-app pop-ups before they take effect.
