Privacy Policy

Gemzy (“we,” “our,” or “us”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and safeguard your data when you use the Gemzy app or website.

2. Information We Collect

When you use Gemzy, we may collect the following types of information:

Account Information: Name, email address, and (in the future) phone number when you create an account via email, Google, or Apple sign-in. If you use Apple sign-in with a private relay email, we receive only the relay address Apple provides.
Payment Information: Payments are processed by the Apple App Store and Google Play (and may later include Stripe or PayPal). We do not store your payment card details.
Subscription Information: Subscription status, plan, and purchase history, managed through our payments and subscription provider (RevenueCat) in connection with the app stores.
User Content: Jewelry designs, model reference photos, other images you upload, and the images generated for you within Gemzy. We process this content to deliver the service. We do not view the content of the images you upload or generate, and we do not use your images to train AI models. See Section 4 for details.
Product Selections: The choices you make in the app (such as model, mode, and style selections) used to generate your results.
Device & Usage Data: IP address, device identifiers, cookies, analytics, and activity data used to operate the service, improve your experience, and maintain security.
Session Recordings: We record in-app interaction sessions (screen flows, taps, navigation, errors, crashes, and performance) through our product analytics provider (PostHog) to diagnose issues and improve the app. Image content is masked in these recordings. We do not capture or view the jewelry designs or images you upload or generate.

3. How We Use Your Information

We use the information collected to:

Provide and operate the Gemzy app and services.
Enable account creation, purchases, and personalized features.
Process transactions securely via third-party payment providers.
Analyze usage and monitor app performance, stability, and errors.
Measure and attribute the performance of our advertising.
Communicate with you (including service updates, promotional emails, and push notifications).
Improve our products and conduct research using aggregated or anonymized data. We do not use the images you upload or generate to train AI models.

4. User Content and AI Processing

Gemzy generates imagery using third-party AI technologies. To do this, the images and selections you provide are transmitted to and processed by these AI providers solely to generate your results.

We do not view the content of the images you upload or generate.
We do not use your images to train AI models, and we do not permit them to be used to train our own models.
Our AI providers process your content only to perform the generation requested and in accordance with their terms.

5. Sharing of Information

We do not sell your data.

We share limited information with trusted third parties only as necessary to provide and operate our services, including:

Payment and subscription providers (the Apple App Store, Google Play, RevenueCat, and in the future Stripe/PayPal).

Hosting and database providers (e.g., Supabase).

Product analytics providers (e.g., PostHog, Amplitude, Google, Apple).

Advertising and attribution providers (e.g., Meta, TikTok, and Reddit) through their SDKs, to measure advertising performance and reach relevant audiences. This may involve sharing device identifiers and app event data.

AI generation providers, which process your content only to generate your results.

These third parties are authorized to use your information only as necessary to provide their services.

6. Your Privacy Choices and Advertising

Some of the advertising and attribution SDKs described above may involve “sharing” of personal information for cross-context behavioral advertising under certain laws (such as the California Consumer Privacy Act), even though we do not sell your data for money.

You can limit ad tracking through your device settings (for example, Apple’s App Tracking Transparency prompt and the Limit Ad Tracking / opt-out controls on iOS and Android).

7. Your Rights

Access & Deletion: You may request a copy of your data or ask us to delete it by contacting privacy@gemzy.co, or by deleting your account in the app.

Marketing Preferences: You may unsubscribe from promotional emails at any time.

Account Control: You may manage your content and account directly through the app.

Depending on where you live, you may have additional rights under local laws (such as the GDPR in the European Economic Area and the CCPA/CPRA in California), including rights to access, correct, delete, or port your data, and to object to or restrict certain processing. We honor these rights as required by applicable law.

8. Data Retention

We retain your account and associated data for as long as your account remains active.

If you delete your account, we retain your data for 30 days, after which it is permanently deleted, except where we are required to retain certain information to comply with legal, tax, or regulatory obligations.

Aggregated or anonymized data that no longer identifies you may be retained for analytics and research.

9. Security

We take reasonable measures to protect your information, including the use of secure servers, encryption, and restricted access. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

Children’s Privacy

Gemzy is not intended for children under the age of 18. We do not knowingly collect data from individuals under this age. If we become aware of such data, we will delete it.

11. International Data Transfers

Gemzy operates globally. Your information may be transferred to and stored on servers located outside your country of residence. Where required, we use appropriate safeguards for such transfers. By using our services, you consent to such transfers.

12. Updates to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the app and/or via email before the changes take effect.
